Monitoring of field of technology and competitors
At the client’s request, we set up profiles to monitor publication of patents and patent applications in a specific area of technology or of competitors’ patents and patent applications. We identify and report new findings on a regular basis. Technology and competitor monitoring is often part of a company’s business intelligence and helps the company to understand and predict developments and activities in the field of technology, on the relevant market and of the competitors.
Availability searches
An availability search is a preparatory investigation to find out the possibilities of having a certain trademark registered on selected markets. We make an assessment of the mark’s registerability, or whether the proposed mark risks infringing an existing right. We offer and carry out national and full international availability searches and report on whether there is anyone who already holds an identical or similar trademark, as well as whether there are any other obstacles.
Market surveys
The purpose of the market survey is usually to show that a particular mark is perceived by the relevant public as a trademark for goods and services that it covers. We help to structure and carry out market surveys to these latter so that these may be later accepted as evidence in an ongoing dispute.
Infringement investigations
In case of suspected infringements we investigate if competitor business or product infringes on the intellectual property rights of the client. It requires a closer analysis of the competing product and also involves an assessment of whether the product actually infringes the patent, based on a comparison of product features on the one hand and the patent claim language reads on the other.
In cases of alleged infringement, we examine whether client’s business or product infringes a patent that a counterparty alleges, based on a comparison of product features on the one hand and the patent claim language reads on the other.
